famikat.com is operated by FAMIKAT. Throughout this page, "we", "us" and "our" mean FAMIKAT, and "you" means anyone browsing the site or buying from it.

By using this site or placing an order you accept these terms. Please read them before you buy. If you do not agree with them, please do not use the site.

1. Who can order

You must be at least the age of majority where you live, or have the consent of a parent or guardian. You agree not to use our products for any unlawful purpose, and not to break any law of your own jurisdiction — including copyright and export law — in connection with your use of the site.

2. Products and how they are described

Every artwork is handmade. Small variations in LED brightness, exact tube bend, acrylic edge finish and colour temperature are inherent in the process and are not defects.

Colours on your screen depend on your display. We photograph our work honestly and calibrate where we can, but we cannot promise your screen matches the physical piece exactly.

Dimensions listed are measured across the widest point of the artwork and carry a tolerance of roughly one centimetre.

Product availability, designs and prices may change at any time without notice. We may limit quantities, restrict sales to a particular region, or discontinue a design.

3. Prices and payment

All prices are shown in US dollars unless another currency is displayed, and exclude import duties and local taxes, which are covered in our Shipping Policy.

Payment is taken in full at checkout. Your order is a request to buy; the contract is formed when we send the order confirmation email.

We take reasonable care with pricing, but if an item is listed at an obviously incorrect price through human or system error, we may cancel the order and refund you in full even after confirmation. We will always contact you first and give you the chance to reorder at the correct price.

4. Custom orders

Custom work follows a fixed sequence:

You send your text, logo or artwork and choose size, colours and backing.
We produce a digital proof showing the design, dimensions and colours.
You approve the proof, or ask for changes. Reasonable revisions are free.
Production begins only after written approval.

The approved proof defines what we are obliged to deliver. Please check spelling, spacing and dimensions carefully — a typo you approved cannot be remade at our cost. Changes requested after approval may be chargeable and will move the delivery date.

By submitting artwork you confirm that you own it or have permission to have it reproduced, and you accept responsibility for any third-party claim arising from what you asked us to make. We decline any request to reproduce a trademark, logo or copyrighted design without evidence of the right to use it, and we may cancel and refund an order where such evidence is not provided.

5. Safety and correct use

Our artwork is designed for indoor use unless the product page says otherwise. Use only the power supply we provide. Do not immerse a piece in water, expose it to direct rain, or run it from a damaged cable or adapter.

Follow the installation instructions supplied. Where a piece is heavy or mounted above head height, we strongly recommend professional installation. We are not liable for injury or property damage caused by incorrect installation, misuse, or modification of a product after delivery.

6. Returns, warranty and delivery

Our Returns & Refunds Policy and Shipping Policy form part of these terms and set out your rights in full.

7. Accuracy of the site

We work to keep the site accurate and current, but content may occasionally contain errors, omissions or out-of-date information. We are not obliged to update it except where the law requires. Any reliance you place on the material here is at your own risk.

8. Accounts

If you create an account you are responsible for keeping your password confidential and for activity that happens under your login. Tell us immediately if you suspect unauthorised access. We may suspend or close an account used for fraud, abuse, or repeated breaches of these terms.

9. Your content

If you send us reviews, photographs, comments or ideas, you grant us a non-exclusive, royalty-free right to use, reproduce and publish them in connection with our business, without payment.

You agree not to send content that is unlawful, defamatory, obscene, hateful, or infringes anyone's rights. We may remove such content at any time. We are under no obligation to keep, publish or reply to anything you submit.

10. Third-party links and services

The site may link to third-party sites or embed third-party tools. We do not control them, do not review their content, and are not responsible for their material, accuracy or practices. Complaints about a third-party product or service should go to that third party.

11. Intellectual property

All original designs, photographs, text and site content are the property of FAMIKAT or our licensors and are protected by copyright. You may not reproduce, resell or commercially exploit any of it without written permission.

Buying an artwork gives you ownership of the physical object. It does not transfer copyright in the design.

12. Limitation of liability

To the fullest extent permitted by law, FAMIKAT is not liable for indirect, incidental or consequential loss arising from your use of the site or our products — including lost profits, lost business, or loss of data.

Where liability cannot be excluded, it is limited to the amount you paid for the order concerned.

Nothing in these terms excludes liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded. Consumers keep all statutory rights, which these terms do not affect.

13. Indemnity

You agree to indemnify FAMIKAT against any claim or demand, including reasonable legal fees, arising from your breach of these terms or from artwork you supplied for a custom order that infringed a third party's rights.

14. Termination

These terms remain in effect while you use the site. You may stop at any time. We may terminate your access if we believe you have breached the terms, and obligations incurred before termination survive it.

15. Governing law

These terms are governed by the laws of the State of New Mexico, United States, and any dispute falls to the courts of that jurisdiction — save that consumers may also bring proceedings in the courts of their own country of residence where local law gives them that right.

16. Changes

We may update these terms; the current version is always on this page with its date. Continuing to use the site after a change means you accept it. The terms in force when you placed an order are the ones that govern that order.

17. Severability and entire agreement

If any provision is held unlawful or unenforceable, it is severed and the remainder stays in force. These terms, together with the policies referenced in them, are the entire agreement between us and replace any earlier understanding.
